CMS, through its state agencies, conducts annual inspections of nursing homes to determine if they are providing quality care to their residents. The inspections are done at least annually but can also be triggered by individual complaints.
Nursing homes with the worse inspection records are identified through the Special Focus Facility (program) typically based on recurring adverse inspection findings. Once a facility is identified through the program, CMS conducts a full, onside inspection of Medicare’s health and safety requirements every six months and can recommend more aggressive enforcement in the form of civil penalties, deficiencies and even exclusion from the Medicare program. “Since most nursing homes rely on Medicare funding, exclusion from the program can put a nursing home out of business,” explains Virginia nursing home attorney Jeffrey Downey.
As of January 2024, the following nursing homes are on the SFF list. The table below lists the most recent inspection dates and whether the nursing home met the criteria for compliance with federal standards. Federal nursing home standards can be found in OBRA 1987 and the implementing regulations at 42 C.F.R. § 483.10, et seq.
